4.

itself as coming from the imagelinkusa.net servers or claims to

include a complete and accurate copy of the message that you
consider to be spam, along with full message headers and routing
information for e-mail, a message board provided by a Web site
or an online service, Usenet, interactive chat message, or instant
message service, as the case may be.
5.
Definition of Spam.
Unsolicited commercial e-mail and electronic messages are
colloquially referred to as spam. Other common names for spam
include spam e-mail, junk e-mail, bulk e-mail, direct e-mail,
and mass e-mail. Spam is the electronic equivalent of the direct
mail you receive in your postal mailbox frequently.
In its most general terms, and as used in this NO-SPAM Policy
(the Policy), spam is:
"
a commercial e-mail message or other electronic
message, including, but not limited to, messages that are:
"
posted to an electronic mailing list (other than
an opt-in e-mail list as described below),
"
posted on an online bulletin board system or
Web-based message board system or guest book,
"
posted to a Usenet newsgroup,
"
posted to the common area of an online community,
group, or club,
"
posted in a chat room,
"
posted in a message board of a commercial online
service (such as America Online),
"
posted to a Weblog (blog),
"
sent via an instant message system (such as ICQ,
Yahoo! Pager, Yahoo! Instant Messenger, or AOL Instant Messenger),
"
sent through e-mail or another Internet means
of communication when the messages ultimate destination is a
facsimile (fax) machine, cellular or wireless telephone, or wireless
device,
"
a commercial e-mail message or other electronic
message that is addressed to one or more recipients with whom
you do not have an preexisting business or personal relationship,
"
a commercial e-mail message or other electronic
message that is sent to a mailing list of addresses that you
purchased or that were otherwise distributed, or any list of
e-mail addresses whose owners did not sign up for your specific
mailing list, including without limitation lists commonly known
as affiliate lists,
"
a commercial e-mail message or other electronic
message that is not sent at the request of, or with the express
consent of, the recipient(s),
"
a commercial e-mail message or other electronic
message that is sent to a recipient who has opted out of receiving
further commercial electronic messages from you, or
"
a commercial e-mail message or other electronic
message that contains forged headers, compromised mail server
relays, or false contact information.
For purposes of this Policy, spam
also includes any e-mail or other electronic message that is
sent in violation of any applicable Federal, state, or local
law regulating unsolicited commercial e-mail, unsolicited fax
transmissions, or any other type of unsolicited commercial electronic
message, regardless of whether that message fits the definition
of spam provided above.
6.
Opt-in E-mail Lists.
Please note: messages sent to opt-in
e-mail lists are not spam, for purposes of this Policy, provided
that those messages meet all of the following criteria:
"
the messages are sent to an opt-in e-mail list
in which ALL subscribers have VOLUNTARILY agreed to receive announcements
and advertisements about products and services;
"
the messages STRICTLY COMPLY with ALL the requirements
and regulations of the opt-in e-mail list; and
"
upon request of any subscriber to the opt-in
e-mail list, you immediately stop sending that subscriber any
e-mail regarding your products and services.
If you choose to use an opt-in e-mail list, please be aware
that ImageLinkUSA will consider ANY violation of the requirements
or regulations of such any third party provider of software or
services for such a list to be a violation of this NO SPAM Policy.
Furthermore, ImageLinkUSA reserves the right to prohibit opt-in
e-mail lists in the future if such a prohibition is reasonably
necessary to keep its hosting service operating efficiently for
all users.
7.
Zero Tolerance for Spam.
ImageLinkUSA will not tolerate any spamming by any of its
Customers. This prohibition of spam extends to the sending of
unsolicited mass mailings from another service, which in any
way implicates the use of ImageLinkUSAs services whether or not
the message actually originated from our network.
Violation of this NO-SPAM policy will result in ImageLinkUSA
taking one or more of the following actions:
A warning via e-mail or telephone,
Suspension of your site until furthur notice,
Removal of DNS for the advertised/originating site, or
Temporarily blocking outgoing mail from your site.
Repeated violation of this NO-SPAM policy will result in immediate
disconnection of service with no re-activation.
ImageLinkUSA reserves the right to take all legal
and technical steps available to prevent unsolicited bulk e-mail
or other unauthorized e-mail from being sent from or transmitted
through the ImageLinkUSA Network.
PLEASE
NOTE: The transmission of spam, including the transmission of
counterfeit e-mail, may result in civil and criminal penalties
against the sender, under various federal, state, and local laws
and regulations, including the federal CAN-SPAM Act of 2003.
ImageLinkUSA provides our clients with Web Hosting accounts that permit the use of CGI files, PHP scripts, and other executable programs. Because these scripts use much more system resources than standard HTML pages, certain restrictions must be made governing the use of such "active content" systems. Under most circumstances, we are able to pin-point it to the offending account on the system. The following rules apply to all "active content" files as listed above:
The script must use low system resources.
Scripts that consume a large amount of our RAM or processor will be subject to immediate suspension until the owner can be notified and an alternative solution is reached.
No more that 20% Used
Each user account may not use more than 20% of system resources at any given time. If an account is consistently using 20% or greater system resources, the account holder will be warned and if no action is taken, the account may be suspended.
The scripts may not interact with any server configuration or hardware. Accounts running these scripts are subject to immediate account termination without refund.
No Remote Scripts
The script can not be used or referenced from any other site not hosted by ImageLinkUSA.
The script must execute in a timely fashion.
Any script that uses the processor for more than a few milliseconds is subject to removal.
Keep it Friendly
Any script that appears to be designed specifically to attack or otherwise maliciously affect the server is completely unacceptable, and if such scripts are found in your account the account will be terminated immediately and your actions will be reported to the proper local, state, and federal authorities and legal action will be taken to prosecute the account holder to the fullest extent of the law by ImageLinkUSA.
Perl-based chat room scripts are strictly prohibited.
Scripts must be kept secure.
Unnecessary chmoding scripts to 777 is a violation of this policy. Keeping scripts in a publicly viewable directory (one without a index.html file) is also in violation of this policy.
Any accounts with scripts found in violation of these policies are subject to future scrutiny of all CGI, Perl, and PHP scripts by our System Administrators. If a script is found to be harmful to the system, it will be killed immediately and the account locked down until the account owners have been contacted. Malicious scripts are subject to immediate account termination without refund of any pre-paid monies.
Inappropriate SSH Access
Since we do allow SSH access to accounts ( Jailed Shell Only ), we must monitor your activity through this access as well. We do not allow the use of VI on our servers due to inexperienced users are not familiar with how to properly close a session. Those sessions will continue to run, slowly consuming system resources. Any account found abusing their SSH access ( if granted ) will have that access terminated without the ability to reactivate.
Why do we have this policy?
A Virtual Server is shared. As such, there are many accounts per machine. In all fairness, ImageLinkUSA cannot allow one or two clients to use all of the System resources on a shared machine and have all other clients on the machine suffer because of it. Excessive CPU usage by one or more clients causes extreme slowness in all areas: FTP, Email, Web Sites and more. If the CPU usage gets too far out of hand, all sites hosted on the machine will return Errors and not be accessible in any way. This usage affects our uptime guarantee percentage and will not be tollerated. In order to guarantee uptime, we must monitor all script usage, on all servers.
What happens if I violate this policy?
All accounts that are found to using excessive amounts of system resources will receive an email warning from ImageLinkUSA. This warning will inform you that immediate action must be taken to optimized your script. If you do not reduce the usage within 24 hours of the email being sent, your account may be cancelled.
Simply put, any website found to be conducting illegal activity such as Phishing will be terminated immediately from our servers and all your personal information will be forwarded to the FBI for proper handling.
If your intent prior to ordering a hosting package with us is for this purpose simply choose another host. Our security team works daily scanning all new accounts and existing accounts to ensure everything remains "legal" and if anything is found, we act upon our policies.
Fraudulent signups ( defined as new accounts using stolen or unauthorized credit card information ) are handled in the same manner. We run fraud checks on all accounts prior to activations. The checks are done manually which result in the 1 - 24 hour delay in your account activation. If any account fails our fraud checks, we simply close the account, refund any payment back to the proper card holder and report all information obtained ( including IP address, trace routes and geographic location of the offender ) to the proper authorities. Fraudulent orders that do not pass our checks are not notified of denial, they are simply removed.
